Terms and Conditions

Combined Terms and Conditions for Personal Training, Group Classes, and Holistic Nutrition Counseling

 

1. Provider and Scope of Application

These Terms and Conditions apply to personal training, group classes, and holistic nutrition counseling, including online services. The service description, price, and appointment confirmation, together with these Terms and Conditions, constitute the contract.

 

2. Conclusion of the Contract and Services

The contract is concluded upon confirmed registration, appointment confirmation, or acceptance of an offer. The Provider is obligated to provide the agreed-upon services in a professional manner; however, the Provider is not obligated to achieve specific training, health, therapeutic, or weight-loss results.

 

3. Health, Cooperation, and Limitations

  • All relevant medical conditions, diagnoses, medications, injuries, pregnancy, allergies, intolerances, and treatments must be fully disclosed.

  • Personal training and group classes require that participants be medically fit. Any warning signs must be reported immediately; the provider may adjust or discontinue services or require a doctor’s clearance.

  • Nutritional counseling is not a substitute for a medical diagnosis or treatment. Medications and medical therapies must not be altered without the approval of a qualified professional. Emergencies require medical treatment.

  • For minors, the necessary consent of the legal guardian must be obtained.

4. Appointments and Cancellations

  • Individual appointments: Free of charge up to 24 hours in advance; after that, the full price applies unless the slot is refilled.

  • Course series: The cancellation deadlines specified in the course description apply. Unless otherwise specified: Free of charge up to 14 days in advance; 50% between 13 and 7 days in advance; 100% thereafter—in each case, provided the slot cannot be refilled.

  • In the event of cancellation by the provider, a replacement session, credit, or refund will be offered. Delays on the part of the client do not extend the appointment time.

5. Prices, Payment, Packages, and Insurance

  • Prices are in CHF as specified in the quote/booking. The current individual session fee is CHF 150 per 60 minutes, unless otherwise confirmed. Prices for group sessions are based on the respective course description. Laboratories, materials, rooms, travel, or third-party services are included only if expressly stated.

  • The payment term is 14 days. Packages are personal and must be used within 12 months, subject to a reasonable solution in the event of a prolonged, medically confirmed inability to attend.

  • Clients are responsible for arranging reimbursements from their supplemental insurance; acknowledgments or registrations do not guarantee coverage of costs.

6. Special Rules for Groups and Online Programs

  • The provider may cancel a session if the number of participants is too low or offer a reasonable, equivalent alternative.

  • Missed group sessions may be made up within the current course.

  • For online exercise programs, the participant is responsible for ensuring a safe exercise space. Recordings and links are personal and may not be shared.

7. Laboratories and Third Parties

  • Third-party laboratories and other external providers perform their services under their own responsibility and on their own terms.

  • Health data or samples will be disclosed only to the extent necessary and with an appropriate legal basis or consent. Abnormal findings must be clarified by a physician.

8. Data Protection and Confidentiality

  • Personal data and particularly sensitive health data are processed in a manner that is purpose-limited, proportionate, and secure. Details are provided in the separate privacy policy.

  • Information is shared with physicians, laboratories, insurers, or family members only to the extent permitted by law and — where required — after obtaining informed consent.

  • Photos, videos, testimonials, and group chats require separate, voluntary consent.

9. Liability and Insurance

The Provider is liable to the extent required by law. To the extent permitted by law, liability for slight negligence is excluded; liability for willful misconduct and gross negligence remains unaffected. Clients are responsible for ensuring adequate accident and health insurance coverage. The Provider assumes no liability for unauthorized changes to medical treatments, incomplete information, or independent third-party services, to the extent permitted by law.

10. Copyright

Documents, plans, prescriptions, videos, and recordings may only be used for personal purposes and may not be shared, published, or commercially exploited without consent.

11. Final Provisions

  • Swiss law applies. Mandatory statutory jurisdictions remain reserved.

  • Should any provision be invalid, the validity of the remaining provisions shall remain unaffected; such provision shall be replaced by the applicable statutory provision.

  • Changes to these Terms and Conditions shall take effect for services already booked only with the client’s consent. The version in effect at the time the contract is concluded shall remain authoritative.
